1. Acceptance of Terms

By accessing or using Mold Cake (the "Service"), whether through our website or our iOS mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Mold Cake is a product operated by Dubanalog, Inc. ("we," "us," or "our"), a corporation incorporated in the State of Alaska, United States.

2. Description of Service

Mold Cake is a platform for mold-ripened cheese enthusiasts. The Service allows users to:

  • Discover and browse mold-ripened cheeses
  • Create and share reviews and ratings
  • Upload and share photos
  • Save favorite cheeses
  • Discover stores and events
  • Request cheeses to be added to the database (when your request is approved and added, you'll receive a one-time email notification)

Mold Cake does not provide direct user-to-user communication, following, or messaging features.

Features may vary between the website and mobile application.

3. User Accounts

3.1 Account Creation

Accounts are created using Google or Apple Sign-In. You agree to:

  • Provide accurate information
  • Maintain account security
  • Notify us of unauthorized access

3.2 Account Responsibility

You are responsible for all activity that occurs under your account.

3.3 Display Names

You must set a display name when you first log in. Display names must be unique, non-offensive, and must not impersonate others.

3.4 Age Requirement

You must be at least 13 years old to use the Service. In certain jurisdictions, users under 16 may require parental consent.

4. User Conduct

You agree not to:

  • Post false, misleading, or illegal content
  • Harass or abuse others
  • Upload malware or harmful code
  • Infringe intellectual property
  • Evade bans or restrictions

5. User-Generated Content

5.1 Ownership

You retain ownership of the content you upload or submit to the Service.

5.2 License

By uploading content, you grant Dubanalog, Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, distribute, reproduce, and promote such content solely in connection with operating, improving, and promoting the Service.

5.3 Prohibited Content

You agree not to upload, post, or share content that:

  • Contains profanity, obscenity, or sexually explicit material
  • Promotes violence, harassment, or discrimination
  • Is illegal, fraudulent, or deceptive
  • Infringes intellectual property rights
  • Violates privacy or publicity rights
  • Contains malware or harmful code
  • Is spam or unsolicited promotional content

5.4 Moderation

Content is currently moderated manually. In the future, moderation may include automated tools and user reporting mechanisms. We do not pre-screen content but reserve the right to review and remove content that violates these Terms or applicable law.

5.5 Rights and Permissions

By uploading, posting, or sharing any content (including photos) on Mold Cake, you represent and warrant that:

  • You own the content or have obtained all necessary rights, licenses, and permissions to upload and share it
  • The content does not infringe any copyright, trademark, privacy, publicity, or other rights of any third party
  • You have the legal right to grant the license described in these Terms

You are solely responsible for the content you upload and for any claims arising from it.

5.6 Content Indemnification

You agree to indemnify and hold harmless Dubanalog, Inc. from any claims, damages, losses, or expenses (including legal fees) arising out of or related to:

  • Content you upload or share
  • Your violation of these Terms
  • Any claim that your content infringes the rights of a third party

6. Intellectual Property

All non-user content, branding, features, and functionality of the Service are owned by Dubanalog, Inc. Mold Cake and its logo are trademarks of Dubanalog, Inc.

7. Privacy

Your use of the Service is governed by our Privacy Policy.

Personal data is processed based on one or more of the following legal grounds: performance of a contract, your consent, compliance with legal obligations, and our legitimate interests in operating and improving the Service.

8. Account Deletion and Termination

You may delete your account at any time:

  • Through the iOS application
  • Via the website account settings
  • By emailing [email protected]

Upon deletion:

  • Personal data is deleted or de-identified
  • Public content may be anonymized or removed
  • Reviews, photos, and events you created are deleted
  • Aggregated data (such as overall ratings and review counts) may be retained in a non-identifiable form
  • Access to the Service is permanently revoked

We may suspend or terminate accounts for violations of these Terms.

9. Mobile Application Terms

The Mold Cake iOS application is subject to these Terms and Apple's App Store Terms of Service. Apple is not responsible for the Service or its content.

10. Future Paid Services

Mold Cake may offer paid services in the future, including:

  • Subscription-based services
  • Physical product offerings (such as the "Mold of the Month Club" cheese delivery service)
  • Premium features or content

No paid services are currently active. When paid services become available, separate terms and payment policies will apply.

11. Disclaimers

The Service is provided "as is" and "as available." Mold Cake does not provide food safety, medical, or health advice. Always consult qualified professionals regarding food allergies or food safety concerns.

12. Limitation of Liability

To the maximum extent permitted by law, Dubanalog, Inc. shall not be liable for indirect, incidental, consequential, or punitive damages.

Total liability shall not exceed the amount you paid us in the preceding 12 months, except where liability cannot be limited under applicable law.

13. Governing Law and Consumer Rights

These Terms are governed by the laws of the State of Alaska, United States.

If you reside in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits your statutory rights.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Push Notifications

The Service may send push notifications to users who opt in through the iOS application. Notifications may include service-related messages. Marketing notifications will only be sent where permitted by law and with consent.

You may disable push notifications at any time through your device settings or application settings. Push notification features are not currently active.

16. Copyright Complaints (DMCA)

  • Your contact information
  • A statement of good-faith belief
  • A statement under penalty of perjury that the information is accurate
